These Terms and Conditions (“Terms”) govern your use of the website www.tdrive.ae (the “Website”) and the car rental services provided by TOP DRIVE LUXURY CAR RENTAL LLC (“Top Drive”, “we”, “us”, “our”). By accessing the Website or renting a vehicle from us, you agree to be bound by these Terms.
1. Eligibility
To rent a vehicle from Top Drive you must (a) be at least 21 years of age (25 for selected luxury and sports models), (b) hold a valid driver’s licence accepted in the UAE (Emirates ID, GCC licence, or international driving permit alongside your home-country licence), and (c) provide a valid passport or Emirates ID and a credit card in your own name for the security deposit.
2. Booking and Payment
Reservations may be made through the Website, by phone, or in person. A booking is confirmed only once we have received the rental fee (or the agreed AED 300 reservation fee) and acknowledged the booking in writing. We accept Visa, Mastercard, and American Express through a secure PCI-DSS-compliant online payment gateway, in-person card payments at delivery, and cash in AED. All prices are quoted in AED and exclude Salik (toll), traffic fines, fuel beyond the agreed allowance, and any optional extras unless stated otherwise.
3. Security Deposit
A refundable security deposit is held against each rental and is released after the vehicle is returned and inspected, provided no traffic fines, Salik charges, damages, or other deductions apply. The deposit amount depends on the vehicle category and is disclosed at the time of booking.
4. Use of the Vehicle
You agree to use the vehicle only for lawful private purposes within the United Arab Emirates. The following are strictly prohibited: (a) driving under the influence of alcohol, drugs or any substance impairing fitness to drive; (b) racing, off-roading, stunt driving, or any motorsport use; (c) sub-letting, ride-sharing, or commercial transport of passengers; (d) carrying more passengers or cargo than the vehicle is rated for; (e) leaving the UAE without our prior written consent. Breach of this clause voids insurance and makes you liable for the full value of any loss or damage.
5. Traffic Fines, Salik and Tolls
You are responsible for all traffic fines, Salik charges, parking fines, and any administrative recovery fees incurred during the rental period. These will be deducted from the security deposit or invoiced separately.
6. Insurance and Liability
Each vehicle is rented with comprehensive insurance subject to a deductible (excess) which is disclosed at the time of booking. You remain liable up to the deductible amount for any single incident, and for the full value of damage or loss caused by use that breaches these Terms or invalidates the insurance policy.
7. Accidents, Damage and Theft
In the event of any accident, damage, or theft, you must (a) immediately notify the Dubai Police and obtain an official police report, and (b) notify Top Drive within one hour. No insurance claim will be honoured without a police report.
8. Late Return and Extensions
Returning the vehicle after the agreed return time without a written extension will be charged at the daily rate, with a grace period of one hour. Extensions may be requested by phone or email and are subject to availability.
9. Intellectual Property
All content on the Website — including the Top Drive name, logo, vehicle photography, copy, and the design of the Website itself — is the property of TOP DRIVE LUXURY CAR RENTAL LLC or its licensors and is protected by UAE and international intellectual property laws. You may not reproduce, distribute, or use any part of the Website for commercial purposes without our prior written permission.
10. Limitation of Liability
To the maximum extent permitted by UAE law, Top Drive shall not be liable for indirect, consequential, or special damages, including loss of profits, loss of data, or loss of business opportunity, arising out of or in connection with the use of the Website or the rental of any vehicle. Our total liability in respect of any rental shall not exceed the rental fee paid for that booking.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates and of the Emirate of Dubai. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
12. Changes to These Terms
We may update these Terms from time to time. The version published on the Website at the time of your booking is the version that applies to that booking.
